These terms apply when you use Forever a Star. By creating an account you agree to them.
Who runs this site
Forever a Star is operated by Namic BV, registered office in Bierbeek, Belgium, enterprise number KBO 0824.010.149, VAT BE0824.010.149. Email: [email protected].
Your account
- You must be at least 16 years old to create an account.
- Keep your password to yourself. Anything done through your account is treated as done by you.
- Your username is shown publicly. You can change it, but only a limited number of times in a given period — handles that change constantly make it impossible for other people to know who they are talking to.
- Don't impersonate somebody else, and don't create accounts to evade a block or ban.
What you post
You keep ownership of the memorials, photos and messages you post. You give us permission to store and display them on the site so that the site can work — nothing more. That permission ends when you delete the content, except for copies we are required to keep.
Only upload a photo if it is yours or you have the right to use it. Memorials are for pets. Don't post anything unlawful, hateful, harassing, or designed to distress other people — this is a site full of grieving owners, and it only works if it stays kind.
Reporting and moderation
Any memorial or guestbook message can be reported from the page it appears on. We review reports and may remove content or suspend an account.
If we remove something you posted or restrict your account, we will tell you what we removed and why, and how to contest it. Write to [email protected] if you think we got it wrong.
Paying for premium
Premium is optional. It belongs to one memorial, not to your account, and is paid once: the price on the Premium page, VAT included, with nothing that renews. The sale is made by Stripe as merchant of record, through its Link service, on Stripe’s own pages; we never see your card details. Stripe sends you the receipt and the invoice, and your card statement names Link.
Premium is switched on as soon as your payment goes through. By paying, you ask for it to be delivered at once and you acknowledge that you thereby give up the 14-day right of withdrawal that consumer law would otherwise give you for a purchase made online; Stripe, as the seller, applies the consumer rules that go with that. Refund requests go to Stripe, which decides them under its own rules; if a payment is refunded, the memorial returns to the free plan. If premium cannot be activated after you have paid, you are refunded in full. Your statutory rights are unaffected.
In the iOS app, premium is bought through Apple’s App Store instead. Apple takes that payment and sends the receipt, its own terms and refund process apply, and if Apple refunds the purchase, the memorial returns to the free plan.
A gift code makes one memorial premium, once. It cannot be exchanged for money, and we may cancel a code that was obtained or used dishonestly.
Ending it
You can delete your account at any time from your settings. It is deactivated at once and permanently erased 30 days later, and you choose whether your memorials go with it. We may suspend or close an account that seriously or repeatedly breaks these terms.
What we can and cannot promise
We look after this site carefully, but we do not guarantee it will be available without interruption, and we cannot promise a memorial will exist forever regardless of what happens to us. Keep your own copy of any photo that matters to you.
Nothing here limits our liability for death, personal injury, fraud, or anything else the law does not let us exclude. Your statutory rights as a consumer are unaffected.
Which law applies
Belgian law applies, and any dispute is subject to the exclusive jurisdiction of the competent courts of Belgium — without prejudice to mandatory consumer rules that give you the right to bring proceedings where you live.
Changes
We will update the date at the top when these terms change, and tell you before a material change takes effect.
